Home Giveaway Fundraising Initiatives

Thank you for supporting Homes with Heart25 Corporation (“Sponsor”).

These Official Rules govern participation in our charitable Home Giveaway Fundraising Events (“Initiatives”). Submission of an entry, whether accompanied by a voluntary contribution or not, constitutes full and unconditional agreement to these terms. Sponsor’s interpretation of these Rules shall be final.

Void where prohibited. Subject to all applicable federal, state, and local laws.

1. Eligibility

Participation is open to legal residents of the United States who are 18 years or older at the time of entry and who meet all category-specific eligibility requirements described in the Initiative materials.

The following individuals are not eligible to participate or receive appreciation awards: Employees, officers, directors, contractors, or agents of Homes with Heart25 Corporation or PLM Construction, LLC. Immediate family members of such individuals. Individuals residing in the same household as any of the above “Immediate family members” include spouses, parents, in-laws, siblings, children, grandparents, grandchildren, and step-relations.

2. Entry Submission

Entries may be submitted online through the official Homes with Heart25 website.

Contributions are non-refundable. There is no limit on number of entries.

Participants will receive confirmation with a unique entry identification number.

Entries may be transferred to another individual who meets the eligibility requirements of the applicable Initiative, subject to verification and approval by Sponsor. All entries must ultimately be associated with a qualified entrant. Sponsor may, in its sole discretion, refuse, void, or cancel any entry determined to be in violation of these Rules. Free Entry: A no-purchase-necessary entry option is available.

Requests must be received prior to the close of the applicable fundraising initiative. Limit one (1) free entry per person per initiative. Free entries are issued only after the entrant has reviewed, completed, and acknowledged the required legal disclosures associated with that initiative.

3. Initiative Structure & Community Appreciation Awards

Each Initiative may select up to five (5) eligible recipients: Across all Initiatives, there may be up to 25 total recipients. Actual numbers may vary based on participation and eligibility verification.

A. One (1) Home Appreciation Award Recipient:

Offered the newly constructed home associated with the Initiative (subject to verification).

B. Up to Four (4) Alternative Appreciation Gift Recipients:

Each may receive an appreciation award of up to $12,500, depending on final Initiative proceeds.

4. Home Appreciation Award – Cash Alternative Option

Recipients selected for a home appreciation award may elect to receive a one-time alternative award equal to 50% of the home’s fair market value at closing.

All tax obligations belong solely to the recipient.

5. Recipient Notification & Verification

Selected individuals will be notified using the contact information provided with their entry.

Sponsor will issue a Recipient Notification Agreement (“RNA”) via secure electronic delivery or certified mail. Recipients must sign and return the RNA within 10 days of receipt.

The RNA will confirm:

A. Identity and eligibility B. Acceptance of the award terms C. Acknowledgment of taxes, fees, and conditions. Individuals who do not respond, cannot be reached, or fail to verify eligibility will forfeit the opportunity, and Sponsor may extend the offer to the next eligible individual. Until verification is complete, all appreciation awards remain the property of Sponsor.

6. Use of Name and Likeness

By accepting an appreciation award, recipients authorize Homes with Heart25 Corporation to use their name, city and state of residence, image, and likeness for promotional and marketing purposes, unless prohibited by law.

7. Selection Oversight

Selections will be conducted by an independent third-party administrator using computer-generated randomization to ensure fairness and compliance.

8. Sponsor’s Right to Modify or Cancel

Sponsor reserves the right to postpone, cancel, or modify any Initiative for reasons including but not limited to technical issues, legal requirements, or force majeure events. In the event of cancellation:

Participants may request contribution refunds in writing within 14 days of cancellation notice. Refunds, if issued, will be returned only to the original payment method and may take up to 60 days to process.

9. Florida Nonprofit Registration and Compliance

Homes with Heart25 Corporation is registered with the Florida Department of Agriculture and Consumer Services (FDACS), Registration No. CH80094, under Chapter 496, Florida Statutes. Registration does not imply endorsement by the State of Florida.

10. Limitation of Liability & Dispute Resolution

By participating, all entrants agree that: Homes with Heart25 Corporation, PLM Construction, LLC, and their officers, directors, employees, contractors, volunteers, and affiliates are not liable for any claims. Any dispute must be resolved through binding arbitration in St. Lucie County, Florida.

11. Additional Disclosures

Participation is void where prohibited, including New York, Rhode Island, and California.

Proceeds support Homes with Heart25’s charitable housing mission and are distributed, in part, to reviewed and approved 501(c)(3) nonprofit partner organizations aligned with housing support.

No donation is necessary to enter or win, and a donation will not increase the odds of selection.

Individuals requesting a free entry will receive an RNA acknowledgment package that must be completed with original signatures and returned via certified mail to Homes with Heart25 Corporation.

12. General Conditions

Sponsor may disqualify any entry submitted through fraudulent, automated, or unauthorized means. Technical failures or tampering that compromise the fairness of an Initiative may result in cancellation, suspension, or modification at Sponsor’s discretion.

13. Donor Disclosure & Tax Information

Homes with Heart25 Corporation is a recognized 501(c)(3) nonprofit organization.

14. Tax Liability for Recipients

Recipients are responsible for all federal, state, and local taxes, fees, and closing costs associated with an appreciation award. Sponsor will issue IRS Form 1099-MISC or 1099-NEC for awards valued at $600 or more. Recipients must submit IRS Form W-9 before award delivery. Recipients selecting the cash alternative will receive 50% of net sale proceeds after closing.

Recipients of home appreciation awards are responsible for:

  • Federal income tax
  • Florida documentary stamp tax
  • Title fees
  • Property taxes
  • HOA dues
  • Insurance
  • Transfer fees
  • Other closing costs

Verification Requirement

ALL SELECTED INDIVIDUALS ARE SUBJECT TO VERIFICATION.

NO INDIVIDUAL IS DEEMED A RECIPIENT UNTIL ELIGIBILITY IS CONFIRMED AND THE RNA PROCESS IS COMPLETE.

Homes with Heart25 Corporation is a registered Florida nonprofit, FDACS License #CH80094. Participation in all initiatives is open with or without a donation. Suggested contributions support Homes with Heart25’s charitable housing mission and are voluntary and non-refundable. Appreciation award recipients are selected according to the Official Rules & Disclosures. No donation is necessary to enter. All promotions are void where prohibited by law, including but not limited to residents of California, New York, and Rhode Island, where additional registration or bonding requirements may apply.
